1. Agreement to Terms

By accessing and using DfenAI's services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your relationship with DfenAI operated by PXL Security LTD. ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. Use License

Permission is granted to temporarily download one copy of DfenAI's materials for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials
• use the materials for any commercial purpose or for any public display
• attempt to reverse engineer any software contained on DfenAI's website
• remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by DfenAI at any time.

3. Service Description

DfenAI provides cybersecurity threat intelligence services including but not limited to:

• Brand risk monitoring and assessment
• Dark web monitoring and intelligence
• Domain security analysis
• Data breach monitoring
• Infrastructure security assessment

We reserve the right to modify, suspend, or discontinue any part of our Service at any time without notice.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to terminate accounts, edit or remove content, and cancel orders at our sole discretion.

5. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as provided in our Refund Policy. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

We reserve the right to change our pricing at any time. If we do change prices, we will provide notice of the change on our website or via email.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law
• Transmit any harassing, libelous, abusive, threatening, or harmful material
• Transmit any material that encourages conduct that could constitute a criminal offense
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use our underground intelligence sources for offensive purposes or re-publishing sensitive data

7. Underground Intelligence Sources

Our Active Threat Intelligence (ATI) service accesses underground sources for defensive cybersecurity purposes only:

• Underground sources: dark-web marketplaces/forums, dark Telegram channels, infostealer dumps (defensive use only).
• PII minimization; no plaintext password storage; time-boxed retention for leaked credentials/artifacts.
• Lawful basis: Legitimate Interests; DPIA maintained.
• Acceptable use: no offensive use or re-publishing sensitive data.

8. Privacy Policy & Data Processing

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

By using our Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

Data Processing Agreement (Enterprise)

Enterprise customers requiring a Data Processing Agreement (DPA) for GDPR compliance can access our comprehensive DPA, which includes:

• EU Standard Contractual Clauses (SCCs) Module Two (Controller-to-Processor)
• Sub-processor details and data protection safeguards
• Technical and organizational security measures
• International data transfer mechanisms
• Data subject rights support procedures

9. Disclaimer

The information on DfenAI's website is provided on an 'as is' basis. To the fullest extent permitted by law, DfenAI excludes all representations, warranties, conditions and terms whether express or implied, statutory or otherwise.

DfenAI shall not be held liable for any damages arising from the use of this website or our services.

10. Limitations

In no event shall DfenAI or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use DfenAI's services.

Our liability is limited to the maximum extent permitted by applicable law.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

12. Changes to Terms

DfenAI reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
